Moorhead Fence & Deck is a licensed and insured contractor offering deck design and construction, fence installation, and related outdoor living services to residential property owners in Moorhead, MN and the surrounding Fargo-Moorhead region. Services are provided on a project-by-project basis. We reserve the right to decline any project at our discretion.
All estimates we provide are based on information available at the time of the site visit or consultation. Written estimates are valid for 30 days from the date issued unless otherwise noted. An estimate is not a guarantee of final price.
Final pricing is set in a written contract signed by both parties before work begins. If unforeseen site conditions arise during construction - such as concealed structural damage, unexpected soil conditions, or permit requirements that were not apparent during the estimate - we will notify you before proceeding and provide a written change order for any additional costs. We will not perform out-of-scope work without your written authorization.
Project start dates are scheduled after a signed contract and any required deposit are received. All scheduled dates are subject to weather conditions and permit processing timelines, which are outside our control. We will communicate any schedule changes as early as possible.
If you need to cancel or postpone a scheduled project, please notify us in writing as soon as possible. Cancellation terms, including any applicable deposit refund or retention policies, are set forth in the individual project contract. Cancellation of work already in progress may result in charges for labor and materials already expended.
Payment terms are stated in the project contract. A deposit is typically required before work begins, with the remaining balance due upon project completion or at milestones set in the contract. We accept payment methods as described in your contract.
Invoices that remain unpaid beyond the due date stated in your contract may be subject to late fees as permitted by applicable law. We reserve the right to suspend or discontinue work on a project where payment obligations are not met.
You are responsible for providing accurate and complete information about your property and project needs. You must ensure we have safe and legal access to the work area on scheduled work days. You are responsible for removing any personal property, furniture, landscaping, or other items from the work area prior to the start of construction.
If your property is subject to homeowners association (HOA) rules or deed restrictions, you are responsible for obtaining any required approvals before work begins. We are not liable for project delays or additional costs arising from your failure to obtain required HOA approvals.
We obtain required building permits on your behalf as part of the project. Permit fees are included in or added to the project contract as itemized. Work will not begin before required permits are issued. We will schedule all required inspections with the local building authority. You are responsible for ensuring the property address and ownership information you provide us is accurate for permit applications.
We warrant our workmanship against defects in installation for a period stated in your project contract. This workmanship warranty covers defects directly resulting from our installation methods and does not cover normal wear and tear, damage caused by weather events, or damage resulting from your failure to perform recommended maintenance.
Materials and products we install may carry their own manufacturer warranties. We will provide you with any available warranty documentation at project completion. We do not extend or guarantee manufacturer warranties beyond their stated terms. Warranty claims must be submitted to us in writing.
To the fullest extent permitted by applicable law, Moorhead Fence & Deck shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to a specific project shall not exceed the total amount paid by you to us for that project. Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, or for any matter where it would be unlawful to exclude or limit liability.
